       Senator Sobel moved the following:
       
    1         Senate Substitute for Amendment (196526) (with title
    2  amendment)
    3  
    4         Delete lines 1079 - 1129
    5  and insert:
    6         (1)This section may be cited as the “Victoria Q. Gaetz
    7  Racing Greyhound Protection Act.”
    8         (2) An injury to a racing greyhound which occurs while the
    9  greyhound is located in this state must be reported on a form
   10  adopted by the division within 7 days after the date on which
   11  the injury occurred or is believed to have occurred. The
   12  presence of cocaine found in a racing greyhound is considered an
   13  injury under this section. The division may adopt rules defining
   14  the term “injury.”
   15         (3)The form shall be completed and signed under oath or
   16  affirmation by the:
   17         (a)Racetrack veterinarian or director of racing, if the
   18  injury occurred at the racetrack facility; or
   19         (b)Owner, trainer, or kennel operator who had knowledge of
   20  the injury, if the injury occurred at a location other than the
   21  racetrack facility, including during transportation.
   22         (4)The division shall fine, suspend, or revoke the license
   23  of any individual who knowingly violates this section or who
   24  intentionally causes an injury to a racing greyhound.
   25         (5)The form must include the following:
   26         (a)The greyhound’s registered name, right-ear and left-ear
   27  tattoo numbers, and, if any, the microchip manufacturer and
   28  number.
   29         (b)The names, business addresses, and telephone numbers of
   30  the greyhound’s owner, trainer, and kennel operator.
   31         (c)The color, weight, and sex of the greyhound.
   32         (d)The specific type and bodily location of the injury,
   33  the cause of the injury, and the estimated recovery time from
   34  the injury.
   35         (e)If the injury occurred when the greyhound was racing:
   36         1.The racetrack where the injury occurred;
   37         2.The distance, grade, race, and post position of the
   38  greyhound when the injury occurred; and
   39         3.The weather conditions, time, and track conditions when
   40  the injury occurred.
   41         (f)If the injury occurred when the greyhound was not
   42  racing:
   43         1.The location where the injury occurred; and
   44         2.The circumstances surrounding the injury.
   45         (g)Other information that the division determines is
   46  necessary to identify injuries to racing greyhounds in this
   47  state.
   48         (6)An injury form created pursuant to this section must be
   49  maintained as a public record by the division for at least 7
   50  years after the date it was received.
   51         (7)A licensee of the department who knowingly makes a
   52  false statement concerning an injury or fails to report an
   53  injury is subject to disciplinary action under this chapter or
   54  chapters 455 and 474.
   55         (8)This section does not apply to injuries to a service
   56  animal, personal pet, or greyhound that has been adopted as a
   57  pet.
   58         (9)The division shall adopt rules to implement this
   59

   64         creating s. 550.2416, F.S.; providing a short title;
   65         requiring injuries to
