    1                        A bill to be entitled                      
    2         An act relating to the Opportunity Scholarship
    3         Program; amending s. 1002.38, F.S.; providing that a
    4         student being promoted to grade 6 or grade 9 may not
    5         receive an opportunity scholarship if the middle
    6         school or high school to which the student is assigned
    7         meets specified criteria; providing an effective date.

    9  Be It Enacted by the Legislature of the State of Florida:
   10  
   11         Section 1. Paragraph (a) of subsection (3) of section
   12  1002.38, Florida Statutes, is amended to read:
   13         1002.38 Opportunity Scholarship Program.—
   14         (3) SCHOOL DISTRICT OBLIGATIONS.—
   15         (a) A school district shall, for each student enrolled in
   16  or assigned to a school that has been designated as provided in
   17  subsection (2):
   18         1. Timely notify the parent of the student as soon as such
   19  designation is made of all options available pursuant to this
   20  section.
   21         2. Offer that student’s parent an opportunity to enroll the
   22  student in a public school within the district that has been
   23  designated by the state as a school performing higher than that
   24  in which the student is currently enrolled or to which the
   25  student has been assigned, but not less than performance grade
   26  category “C.” The student shall have the opportunity to continue
   27  attendance in the higher-performing public school feeder pattern
   28  until the student graduates from high school. Beginning July 1,
   29  2016, a student who meets the eligibility requirements of
   30  paragraph (2)(a) and who is being promoted to grade 6 or grade 9
   31  may not be granted an opportunity scholarship if the middle
   32  school or high school that he or she will attend within his or
   33  her assigned school attendance area has earned a grade of “C” or
   34  better, pursuant to s. 1008.34, for the previous school year.
   35         Section 2. This act shall take effect July 1, 2016.
