       Senator Legg moved the following:
       
    1         Senate Amendment to Amendment (274472) (with title
    2  amendment)
    3  
    4         Between lines 2570 and 2571
    5  insert:
    6         Section 24. Paragraph (a) of subsection (1) of section
    7  1013.62, Florida Statutes, is amended to read:
    8         1013.62 Charter schools capital outlay funding.—
    9         (1) In each year in which funds are appropriated for
   10  charter school capital outlay purposes, the Commissioner of
   11  Education shall allocate the funds among eligible charter
   12  schools.
   13         (a) To be eligible for a funding allocation, a charter
   14  school must:
   15         1.a. Have been in operation for 3 or more years;
   16         b. Be governed by a governing board established in the
   17  state for 3 or more years which operates both charter schools
   18  and conversion charter schools within the state;
   19         c. Be an expanded feeder chain of a charter school within
   20  the same school district that is currently receiving charter
   21  school capital outlay funds;
   22         d. Have been accredited by the Commission on Schools of the
   23  Southern Association of Colleges and Schools; or
   24         e. Serve students in facilities that are provided by a
   25  business partner for a charter school-in-the-workplace pursuant
   26  to s. 1002.33(15)(b).
   27         2. Have an annual audit that does not reveal any of the
   28  financial emergency conditions provided in s. 218.503(1) for the
   29  most recent fiscal year for which such audit results are
   30  available stability for future operation as a charter school.
   31         3. Have satisfactory student achievement based on state
   32  accountability standards applicable to the charter school.
   33         4. Have received final approval from its sponsor pursuant
   34  to s. 1002.33 for operation during that fiscal year.
   35         5. Serve students in facilities that are not provided by
   36  the charter school’s sponsor.

   40         Delete line 2767
   41  and insert:
   42         by the act; amending s. 1013.62, F.S.; revising
   43         requirements for a charter school to be eligible for
   44         funding appropriated for charter school capital outlay
   45         purposes; providing effective dates.
