1 A bill to be entitled
2 An act relating to specialty license plates; amending
3 s. 320.08056, F.S.; establishing an annual use fee for
4 the Ducks Unlimited license plate; amending s.
5 320.08058, F.S.; revising the distribution of proceeds
6 for the Fallen Law Enforcement Officers License Plate;
7 requiring the Department of Highway Safety and Motor
8 Vehicles to develop a Ducks Unlimited license plate;
9 providing for distribution and use of fees collected
10 from the sale of the plates; providing an effective
11 date.

13 Be It Enacted by the Legislature of the State of Florida:

15 Section 1. Paragraph (ffff) is added to subsection (4) of
16 section 320.08056, Florida Statutes, to read:
17 320.08056 Specialty license plates.—
18 (4) The following license plate annual use fees shall be
19 collected for the appropriate specialty license plates:
20 (ffff) Ducks Unlimited license plate, $25.
21 Section 2. Paragraph (b) of subsection (80) of section
22 320.08058, Florida Statutes, is amended and subsection (84) is
23 added to that section, to read:
24 320.08058 Specialty license plates.—
25 (80) FALLEN LAW ENFORCEMENT OFFICERS LICENSE PLATES.—
26 (b) The annual use fees shall be distributed to the Police
27 and Kids Foundation, Inc., which may use up to a maximum of 10
28 percent of the proceeds for marketing to promote and market the
29 plate. All remaining proceeds shall be distributed to and used
30 by the Police and Kids Foundation, Inc., for its operations,
31 activities, programs, and projects The remainder of the proceeds
32 shall be used by the Police and Kids Foundation, Inc., to invest
33 and reinvest, and the interest earnings shall be used for the
34 operation of the Police and Kids Foundation, Inc.
35 (84) DUCKS UNLIMITED LICENSE PLATES.—
36 (a) The department shall develop a Ducks Unlimited license
37 plate as provided in this section and s. 320.08053. Ducks
38 Unlimited license plates must bear the colors and design
39 approved by the department. The word “Florida” must appear at
40 the top of the plate, and the words “Conserving Florida
41 Wetlands” must appear at the bottom of the plate.
42 (b) The annual use fees from the sale of the plate shall be
43 distributed to Ducks Unlimited, Inc., a nonprofit corporation
44 under s. 501(c)(3) of the Internal Revenue Code, to be used as
45 follows:
46 1. Up to 5 percent may be used for administrative costs and
47 marketing of the plate.
48 2. A minimum of 95 percent shall be used in this state to
49 support the mission and efforts of Ducks Unlimited, Inc., for
50 the conservation, restoration, and management of Florida
51 wetlands and associated habitats for the benefit of waterfowl,
52 other wildlife, and people.
53 Section 3. This act shall take effect October 1, 2017.
