Florida Senate - 2017 SB 1232 By Senator Stewart 13-01648-17 20171232__ 1 A bill to be entitled 2 An act relating to specialty license plates; amending 3 ss. 320.08056 and 320.08058, F.S.; directing the 4 Department of Highway Safety and Motor Vehicles to 5 develop an Orlando United license plate; establishing 6 an annual use fee for the plate; providing for 7 distribution and use of fees collected from the sale 8 of the plates; providing an effective date. 9 10 Be It Enacted by the Legislature of the State of Florida: 11 12 Section 1. Paragraph (ffff) is added to subsection (4) of 13 section 320.08056, Florida Statutes, to read: 14 320.08056 Specialty license plates.— 15 (4) The following license plate annual use fees shall be 16 collected for the appropriate specialty license plates: 17 (ffff) Orlando United license plate, $25. 18 Section 2. Subsection (84) is added to section 320.08058, 19 Florida Statutes, to read: 20 320.08058 Specialty license plates.— 21 (84) ORLANDO UNITED LICENSE PLATES.— 22 (a) The department shall develop an Orlando United license 23 plate as provided in this section and s. 320.08053. The plate 24 must bear the colors and design approved by the department. The 25 word “Florida” must appear at the top of the plate, and the 26 words “Orlando United” must appear at the bottom of the plate. 27 (b) The department shall retain all revenue from the sale 28 of such plates until the startup costs for developing and 29 issuing the plates have been recovered. Thereafter, the annual 30 use fees from the sale of the plates shall be distributed as 31 follows: 32 1. Seven percent shall be distributed to the Mental Health 33 Association of Central Florida, Inc., to be used for marketing 34 of the license plate. 35 2. Thirty-one percent shall be distributed to the Mental 36 Health Association of Central Florida, Inc. Of this amount, up 37 to 5 percent may be used for administrative expenses, and the 38 remainder shall be used to offer free personalized counseling to 39 any person affected by the shooting at the Pulse nightclub in 40 Orlando, Florida, on June 12, 2016. 41 3. Thirty-one percent shall be distributed to the Hispanic 42 Federation, Inc., a charitable, not-for-profit organization 43 under s. 501(c)(3) of the Internal Revenue Code registered with 44 the Department of Agriculture and Consumer Services and 45 incorporated in New York. Of this amount, up to 5 percent may be 46 used for administrative expenses, and the remainder shall be 47 used to offer free personalized counseling to any person 48 affected by the shooting at the Pulse nightclub in Orlando, 49 Florida, on June 12, 2016, through the Proyecto Somos Orlando 50 campaign operated by the Hispanic Federation, Inc. 51 4. Thirty-one percent shall be distributed to Two Spirit 52 Health Services, Inc. Of this amount, up to 5 percent may be 53 used for administrative expenses, and the remainder shall be 54 used to offer free personalized counseling to any person 55 affected by the shooting at the Pulse nightclub in Orlando, 56 Florida, on June 12, 2016. 57 Section 3. This act shall take effect October 1, 2017.
