       The Committee on Governmental Oversight and Accountability
       (Bracy) recommended the following:
       
    1         Senate Amendment to Amendment (598206) 
    2  
    3         Delete lines 20 - 36
    4  and insert:
    5  she does not present any danger to society. He or she must have
    6  served at least 50 percent of his or her sentence.
    7         (b)(a) “Permanently incapacitated inmate,” which means an
    8  inmate who has a condition caused by injury, disease, or illness
    9  which, to a reasonable degree of medical certainty, renders the
   10  inmate permanently and irreversibly physically incapacitated to
   11  the extent that the inmate does not constitute a danger to
   12  herself or himself or others.
   13         (c)(b) “Terminally ill inmate,” which means an inmate who
   14  has a condition caused by injury, disease, or illness which, to
   15  a reasonable degree of medical certainty, renders the inmate
   16  terminally ill to the extent that there can be no recovery and
   17  death is imminent, so that the inmate does not constitute a
   18  danger to herself or himself or others.
   19         (2)To be eligible, an inmate must also be determined by
   20  the department to meet all of the following criteria:
   21         (a)Has been convicted of a felony.
