    1                        A bill to be entitled                      
    2         An act relating to mitigation activities within the
    3         St. Johns River Water Management District; amending s.
    4         373.414, F.S.; requiring that the Department of
    5         Environmental Protection and the St. Johns River Water
    6         Management District consider mitigation on specified
    7         land as meeting cumulative impact requirements under
    8         certain conditions; providing an effective date.

   10  Be It Enacted by the Legislature of the State of Florida:
   11  
   12         Section 1. Subsection (20) is added to section 373.414,
   13  Florida Statutes, to read:
   14         373.414 Additional criteria for activities in surface
   15  waters and wetlands.—
   16         (20)When land located within sections 2 through 5, 8
   17  through 11, 14 through 17, and 21 through 28 of Township 26
   18  South, Range 32 East, in Osceola County, contiguous with Lake
   19  Conlin or within the Cat Island Swamp, is used for mitigation of
   20  adverse impacts within drainage basin 18, St. Johns River
   21  (Canaveral Marshes to Wekiva), or within drainage basin 19,
   22  Econlockhatchee River nested in basin 18, as depicted in figure
   23  10.2.8-2 of the “Environmental Resource Permit Applicant’s
   24  Handbook, Volume I (General and Environmental)” as incorporated
   25  by reference in rule 62-330.010, Florida Administrative Code,
   26  and if the mitigation offsets the adverse impacts within the
   27  drainage basin, the department and the St. Johns River Water
   28  Management District shall consider the activity regulated under
   29  part IV of chapter 373 in order to meet the cumulative impact
   30  requirements of paragraph (8)(a).
   31         Section 2. This act shall take effect July 1, 2018.
