The sale or transfer of an assault 8 weapon to a person younger than 21 years of age may not be made 9 or facilitated by any person, including a licensed importer, 10 licensed manufacturer, or licensed dealer. A person who violates 11 this subsection commits a felony of the third degree, punishable 12 as provided in s. 775.082, s. 775.083, or s. 775.084. Solely for 13 the purposes of this paragraph, the term “assault weapon” means 14 a fully automatic or semiautomatic rifle or shotgun or a 15 semiautomatic rifle or shotgun that has a fixed magazine 16 capacity of more than 10 rounds of centerfire ammunition. The 17 term also includes a semiautomatic rifle or shotgun when it is 18 loaded with a detachable magazine having a capacity of more than 19 10 rounds of centerfire ammunition or when the rifle or shotgun 20 is possessed by a person under 21 years of age who also 21 possesses a detachable magazine for the rifle or shotgun which 22 has a capacity of more than 10 rounds of centerfire ammunition. 23 (b) The prohibitions in paragraph (a) do not apply to the 24 purchase of a rifle or shotgun by a law enforcement officer or 25 correctional officer, as those terms are defined in s. 26 943.10(1), (2), (3), (6), (7), (8), or (9), or to a 27 servicemember as defined in s. 250.01.
