Section 16.63, Florida Statutes, is created to 7 read: 8 16.63 Medical Reimbursement Program for Victims of Mass 9 Shootings.— 10 (1) The Medical Reimbursement Program for Victims of Mass 11 Shootings is established in the Department of Legal Affairs to 12 reimburse trauma centers verified or designated pursuant to s. 13 395.4025 for the medical and behavioral health costs of treating 14 victims for injuries associated with a mass shooting. As used in 15 this section, the term “mass shooting” means an incident in 16 which four or more people are killed or injured by firearms in 17 one or more locations in close proximity. The Department of 18 Legal Affairs must reimburse such trauma centers based on a 19 department-approved fee schedule for the documented medical and 20 behavioral health costs of treating victims for injuries 21 associated with a mass shooting. A trauma center that requests a 22 reimbursement through the program may not bill the victim of a 23 mass shooting or his or her family. This section does not 24 prohibit a trauma center from billing a victim’s third-party 25 insurance, Medicaid, or Medicare, if applicable, for services 26 provided to a victim of a mass shooting. This section applies 27 retroactively to June 12, 2016. 28 (2) The Department of Legal Affairs shall adopt rules 29 pursuant to ss. 120.536(1) and 120.54 to implement the program. 30 Section 5. For the 2018-2019 fiscal year, the sum of $10 31 million in recurring funds is appropriated from the General 32 Revenue Fund to the Department of Legal Affairs to reimburse 33 verified or designated trauma centers for documented medical and 34 behavioral health costs of treating victims of mass shootings 35 through its Medical Reimbursement Program for Victims of Mass 36 Shootings. 37 Section 6. Notwithstanding s. 790.06(13), beginning January 38 1, 2019, and each January 1 thereafter, the Department of 39 Agriculture and Consumer Services shall transfer 10 percent of 40 the fees collected for new and renewal concealed weapon or 41 firearm licenses from the Division of Licensing Trust Fund to 42 the Department of Legal Affairs to reimburse verified or 43 designated trauma centers for documented medical and behavioral 44 health costs of treating victims of mass shootings through its 45 Medical Reimbursement Program for Victims of Mass Shootings. 46 47 ================= T I T L E A M E N D M E N T ================ 48 And the title is amended as follows: 49 Delete line 2377 50 and insert: 51 crime watch programs; creating s. 16.63, F.S.; 52 establishing the Medical Reimbursement Program for 53 Victims of Mass Shootings in the Department of Legal 54 Affairs; defining the term “mass shooting”; requiring 55 the department to reimburse verified or designated 56 trauma centers for certain costs associated with 57 treating victims for injuries associated with a mass 58 shooting; prohibiting trauma centers that request such 59 reimbursement from billing victims of mass shootings 60 or their families; providing construction; providing 61 retroactive applicability; requiring the Department of 62 Legal Affairs to adopt rules; providing an 63 appropriation; requiring the Department of Agriculture 64 and Consumer Services to annually transfer a 65 percentage of the fees collected for new and renewal 66 concealed weapon or firearm licenses from the Division 67 of Licensing Trust Fund to the Department of Legal 68 Affairs to reimburse the trauma centers; amending s. 69 20.15, F.S.;
