    1                        A bill to be entitled                      
    2         An act relating to firesafety inspectors; creating s.
    3         633.217, F.S.; prohibiting certain actions to
    4         influence a firesafety inspector to violate the
    5         Florida Fire Prevention Code, other rules of the State
    6         Fire Marshal, or ch. 633, F.S.; providing criminal
    7         penalties; providing an effective date.
    8          
    9  Be It Enacted by the Legislature of the State of Florida:
   10  
   11         Section 1. Section 633.217, Florida Statutes, is created to
   12  read:
   13         633.217 Influencing a firesafety inspector; criminal
   14  penalties.—
   15         (1) A person may not influence a firesafety inspector by:
   16         (a) Threatening, coercing, tricking, persuading,
   17  interfering with, or otherwise influencing; or attempting to
   18  threaten, coerce, trick, persuade, interfere with, or otherwise
   19  attempting to influence, the firesafety inspector into violating
   20  any provision of the Florida Fire Prevention Code, any rule
   21  adopted by the State Fire Marshal, or any provision of this
   22  chapter.
   23         (b) Offering any compensation to the firesafety inspector
   24  to induce a violation of the Florida Fire Prevention Code, any
   25  rule adopted by the State Fire Marshal, or any provision of this
   26  chapter.
   27         (2)A person who violates subsection (1) commits a
   28  misdemeanor of the second degree, punishable as provided in s.
   29  775.082 or s. 775.083. A person who commits a second or
   30  subsequent violation of subsection (1) commits a misdemeanor of
   31  the first degree, punishable as provided in s. 775.082 or s.
   32  775.083.
   33         Section 2. This act shall take effect October 1, 2018.
