       Senator Albritton moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 92 - 114
    4  and insert:
    5         Section 2. Section 163.3214, Florida Statutes, is created
    6  to read:
    7         163.3214Tree pruning, trimming, or removal on single
    8  family residential property.—
    9         (1)A local government may not require a permit, an
   10  application, the provision of a notice, a fee, or impose a fine:
   11         (a)For the pruning, trimming, or removal of a tree on a
   12  single-family residential property if the property owner has
   13  obtained documentation from an arborist certified by the
   14  International Society of Arboriculture or a Florida licensed
   15  landscape architect that the tree is a danger to persons or
   16  property and the tree is not a specimen, heritage, or patriarch
   17  tree, as defined by local ordinances or regulations.
   18         (b)For the pruning or trimming of a specimen, heritage, or
   19  patriarch tree, as defined by local ordinances or regulations,
   20  on a single-family residential property if the property owner
   21  has obtained documentation from an arborist certified by the
   22  International Society of Arboriculture or a Florida licensed
   23  landscape architect that the tree is a danger to persons or
   24  property.
   25         (2)A local government may enforce ordinances or
   26  regulations pertaining to the replacement of trees that have
   27  been removed in accordance with this section. However a local
   28  ordinance or regulation may not require the single-family
   29  residential property owner to replace more than one tree for
   30  each tree removed.
   31         (3)This section does not apply to the exercise of
   32  specifically delegated authority for mangrove protection
   33  pursuant to ss. 403.9321-403.9333 or to trees listed as
   34  endangered species.

   44         property owner obtains specified documentation;
   45         authorizing a local government to enforce ordinances
   46         or regulations pertaining to the replacement of trees;
