       Appropriations Subcommittee on Criminal and Civil Justice
       (Stewart) recommended the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 12 - 32
    4  and insert:
    5         Section 1. Paragraph (c) is added to subsection (14) of
    6  section 775.15, Florida Statutes, paragraph (b) of that
    7  subsection is amended, and subsection (2) of that section is
    8  republished, to read:
    9         775.15 Time limitations; general time limitations;
   10  exceptions.—
   11         (2) Except as otherwise provided in this section,
   12  prosecutions for other offenses are subject to the following
   13  periods of limitation:
   14         (a) A prosecution for a felony of the first degree must be
   15  commenced within 4 years after it is committed.
   16         (b) A prosecution for any other felony must be commenced
   17  within 3 years after it is committed.
   18         (c) A prosecution for a misdemeanor of the first degree
   19  must be commenced within 2 years after it is committed.
   20         (d) A prosecution for a misdemeanor of the second degree or
   21  a noncriminal violation must be commenced within 1 year after it
   22  is committed.
   23         (14)
   24         (b) Except as provided in paragraph (a) or paragraph
   25  (13)(b), a prosecution for a first or second degree felony
   26  violation of s. 794.011, if the victim is 18 16 years of age or
   27  older at the time of the offense, must be commenced within 8
   28  years after the violation is committed. This paragraph applies
   29  to any such offense except an offense the prosecution of which
   30  would have been barred by subsection (2) on or before July 1,
   31  2015.
   32         (c)Except as provided in paragraph (a) or subsection (13),
   33  a prosecution for a felony violation of s. 794.011, if the
   34  victim was 16 years of age or older and younger than 18 years of
   35  age at the time of the offense, must be commenced within 10
   36  years after the violation is committed. This paragraph applies
   37  to an offense that is committed on or after July 1, 2020.

   40  And the title is amended as follows:
   41         Delete lines 4 - 7
   42  and insert:
   43         775.15, F.S.; revising the age of a victim of
   44         specified sexual battery offenses for purposes of
   45         commencing a prosecution within a specified time;
   46         providing that a prosecution must be commenced within
   47         a certain time after a specified sexual battery
   48         offense occurs against a victim of a specified age at
   49         the time the offense was committed;
