       Senator Berman moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Between lines 303 and 304
    4  insert:
    5         Section 4. Paragraph (h) of subsection (3) of section
    6  381.96, Florida Statutes, is amended, paragraph (i) is added to
    7  that subsection, and subsection (5) is added to that section, to
    8  read:
    9         381.96 Pregnancy support and wellness services.—
   10         (3) CONTRACT REQUIREMENTS.—The department contract shall
   11  specify the contract deliverables, including financial reports
   12  and other reports due to the department, timeframes for
   13  achieving contractual obligations, and any other requirements
   14  the department determines are necessary, such as staffing and
   15  location requirements. The contract shall require the network
   16  to:
   17         (h) Ensure that informational materials provided to an
   18  eligible client by a provider include only are current and
   19  accurate information and cite the reference source of any
   20  medical statement included in such materials. Such information
   21  must be:
   22         1. Verified or supported by the weight of medical research
   23  conducted in compliance with accepted scientific methods;
   24         2. Recognized as correct and objective by leading medical
   25  organizations with relevant expertise or by governmental
   26  agencies; or
   27         3. Recommended by or affirmed in the medical practice
   28  guidelines of a nationally recognized accrediting organization.
   29         (i) Ensure that an obstetrician certified by the American
   30  Board of Obstetrics and Gynecology is available during all times
   31  that patients are being treated or counseled.
   32         (5) CRIMINAL PENALTY.—A person who provides informational
   33  materials to a client which are in violation of paragraph (3)(h)
   34  commits a misdemeanor of the first degree, punishable as
   35  provided in s. 775.082 or s. 775.083.
