Senator Brandes moved the following:
1 Senate Amendment (with title amendment)

3 Delete lines 40 - 55
4 and insert:
5 Constitution during an active, ongoing, and good faith
6 investigation of a claim of actual innocence in a case that
7 previously resulted in the conviction of the accused person and
8 until the claim is no longer capable of further investigation or
9 for 2 years, whichever is shorter. If the state presents good
10 cause demonstrating a need for additional time to complete the
11 reinvestigation, the court may grant an extension. This
12 paragraph is subject to the Open Government Sunset Review Act in
13 accordance with s. 119.15 and shall stand repealed on October 2,
14 2026, unless reviewed and saved from repeal through reenactment
15 by the Legislature.
16 Section 2. The Legislature finds that it is a public
17 necessity that conviction integrity unit reinvestigation
18 information be made exempt from s. 119.07(1), Florida Statutes,
19 and s. 24(a), Article I of the State Constitution during an
20 active, ongoing, and good faith investigation of a claim of
21 actual innocence in a case that previously resulted in the
22 conviction of the accused person and until the claim is no
23 longer capable of further investigation or for 2 years,
24 whichever is shorter, unless the court grants an extension.
