    1                        A bill to be entitled                      
    2         An act relating to procurement procedures; amending s.
    3         287.042, F.S.; requiring the Department of Management
    4         Services to develop procedures that require current
    5         and prospective contractors to disclose whether such
    6         contractor is owned or controlled by a foreign
    7         government before providing commodities or contractual
    8         services to the state; requiring any such disclosure
    9         to be in writing, under penalty of perjury; providing
   10         an effective date.

   12  Be It Enacted by the Legislature of the State of Florida:
   13  
   14         Section 1. Paragraph (i) is added to subsection (3) of
   15  section 287.042, Florida Statutes, to read:
   16         287.042 Powers, duties, and functions.—The department shall
   17  have the following powers, duties, and functions:
   18         (3) To establish a system of coordinated, uniform
   19  procurement policies, procedures, and practices to be used by
   20  agencies in acquiring commodities and contractual services,
   21  which shall include, but not be limited to:
   22         (i)Development of procedures that require each current and
   23  prospective contractor, as a prerequisite to providing
   24  commodities or contractual services to the state pursuant to a
   25  contract executed, extended, renewed, or amended on or after
   26  July 1, 2021, to provide the department with a written
   27  declaration pursuant to s. 92.525(2) which discloses whether the
   28  contractor is owned or controlled by a foreign government, as
   29  defined in s. 876.22.
   30         Section 2. This act shall take effect upon becoming a law.
