    1                        A bill to be entitled                      
    2         An act relating to law enforcement officer use of
    3         force deaths; creating s. 900.07, F.S.; requiring the
    4         state attorney of a judicial circuit in which a law
    5         enforcement officer use of force death occurs to
    6         request that a state attorney from another judicial
    7         circuit review the case and make a certain written and
    8         detailed recommendation; requiring a state attorney
    9         who receives such a request to provide a specified
   10         notice to the requesting state attorney within a
   11         certain timeframe; providing an effective date.

   13  Be It Enacted by the Legislature of the State of Florida:
   14  
   15         Section 1. Section 900.07, Florida Statutes, is created to
   16  read:
   17         900.07 Requiring review and recommendations from another
   18  state attorney in cases of law enforcement officer use of force
   19  deaths.—
   20         (1)In each case in which a death results from a law
   21  enforcement officer’s use of force, the state attorney of the
   22  judicial circuit in which the use of force death occurred shall
   23  request a state attorney from another judicial circuit to review
   24  the case and the circumstances surrounding the use of force
   25  death and to make a written and detailed recommendation on
   26  whether he or she believes that charges should be brought
   27  against the law enforcement officer.
   28         (2)A state attorney who receives a request under
   29  subsection (1) must notify the requesting state attorney within
   30  10 business days after receipt as to whether the state attorney
   31  receiving the request can review the case and, if so, provide
   32  the written and detailed recommendation in an expeditious
   33  manner.
   34         Section 2. This act shall take effect July 1, 2021.
