       Senator Farmer moved the following:
       
    1         Senate Amendment (with title amendment)

    3         Between lines 40 and 41
    4  insert:
    5         Section 2. Subsection (2) of section 627.64195, Florida
    6  Statutes, is amended to read:
    7         627.64195 Requirements for opioid coverage.—
    8         (2) COVERAGE REQUIREMENTS.—
    9         (a)A health insurance policy may not require that
   10  treatment with an opioid analgesic drug product or an abuse
   11  deterrent opioid analgesic drug product be attempted and have
   12  failed before authorizing the use of a nonopioid-based analgesic
   13  drug product.
   14         (b) A health insurance policy that provides coverage for
   15  abuse-deterrent opioid analgesic drug products:
   16         1.(a) May impose a prior authorization requirement for an
   17  abuse-deterrent opioid analgesic drug product only if the policy
   18  imposes the same prior authorization requirement for each opioid
   19  analgesic drug product without an abuse-deterrence labeling
   20  claim.
   21         2.(b) May not require use of an opioid analgesic drug
   22  product without an abuse-deterrence labeling claim before
   23  authorizing the use of an abuse-deterrent opioid analgesic drug
   24  product.

   28         Between lines 5 and 6
   29  insert:
   30         amending s. 627.64195, F.S.; prohibiting health
   31         insurance policies from requiring that treatment with
   32         an opioid analgesic drug product or abuse-deterrent
   33         opioid analgesic drug product be attempted and have
   34         failed before authorizing the use of a nonopioid-based
   35         analgesic drug product;
