    1                        A bill to be entitled                      
    2         An act relating to motorcycle specialty license
    3         plates; creating s. 320.0878, F.S.; directing the
    4         Department of Highway Safety and Motor Vehicles to
    5         create a Blue Angels motorcycle specialty license
    6         plate; providing issuance requirements for the plate;
    7         providing for distribution and use of annual use fees
    8         received from the sale of the plate; providing for
    9         transfer of the plate to a replacement vehicle under
   10         certain circumstances; providing design requirements
   11         for the plate; authorizing the department to issue
   12         personalized prestige plates in accordance with
   13         certain provisions; providing a contingent effective
   14         date.
   15          
   16  Be It Enacted by the Legislature of the State of Florida:
   17  
   18         Section 1. Section 320.0878, Florida Statutes, is created
   19  to read:
   20         320.0878Blue Angels motorcycle specialty license plate.—
   21         (1)Notwithstanding s. 320.08053, the department shall
   22  develop a reduced-dimensions Blue Angels specialty license plate
   23  for display on motorcycles.
   24         (2)The department shall issue a Blue Angels specialty
   25  license plate to the owner or lessee of any motorcycle upon
   26  request. Each request must be made annually to the department,
   27  accompanied by the taxes and fees established in s. 320.08781.
   28         (3)The annual use fees collected pursuant to s.
   29  320.08781(4) for the sale of the plate shall be distributed to
   30  the Naval Aviation Museum Foundation, a nonprofit Florida
   31  corporation under s. 501(c)(3) of the Internal Revenue Code, to
   32  fund maintenance, programs, marketing, and projects of the
   33  foundation, including the National Naval Aviation Museum and the
   34  National Flight Academy in Pensacola. Up to 10 percent of the
   35  funds received by the foundation may be used for marketing of
   36  the plate and costs directly associated with the administration
   37  of the foundation. The foundation shall distribute 50 percent of
   38  the funds to eligible programs and projects associated with the
   39  National Flight Academy and the remainder of the funds to
   40  eligible programs and projects associated with the National
   41  Naval Aviation Museum.
   42         (4)If the owner or lessee to whom the department has
   43  issued a Blue Angels motorcycle specialty license plate acquires
   44  a replacement vehicle within the owner’s registration period,
   45  the department must authorize a transfer of the plate to the
   46  replacement vehicle in accordance with s. 320.0609. The annual
   47  use fee and processing fee established in s. 320.08781 may not
   48  be refunded.
   49         (5)The plate shall be 4 inches wide by 7 inches long and
   50  incorporate an image of the Blue Angels approved by the
   51  department and may bear the imprint of numerals from 1 to 999,
   52  inclusive, capital letters “A” through “Z,” or a combination
   53  thereof. The maximum number of characters shall be four,
   54  including letters and numerals, and the design shall be printed
   55  on the far left side of the plate. The Blue Angels motorcycle
   56  specialty license plate must be otherwise of the same material
   57  as standard license plates issued for any registration period.
   58  In small letters, the word “Florida” must appear at the top of
   59  the plate.
   60         (6)The department may issue personalized prestige plates
   61  for the license plate authorized in this section. Such plates
   62  shall be issued in accordance with applicable provisions of s.
   63  320.0805.
   64         Section 2. This act shall take effect October 1, 2022, but
   65  only if SB ____ or similar legislation takes effect, if such
   66  legislation is adopted in the same legislative session or an
   67  extension thereof and becomes a law.
