    1                        A bill to be entitled                      
    2         An act relating to transportation projects; amending
    3         s. 206.46, F.S.; revising the requirement for the
    4         annual commitment of State Transportation Trust Fund
    5         revenues for public transportation projects by the
    6         Department of Transportation; amending s. 337.168,
    7         F.S.; providing that a document that reveals the
    8         identity of a potential bidder on a transportation
    9         project is a public record; amending s. 339.08, F.S.;
   10         authorizing the department to enter into an agreement
   11         with the Division of Florida Highway Patrol of the
   12         Department of Highway Safety and Motor Vehicles to pay
   13         for work zone speed enforcement using moneys in the
   14         State Transportation Trust Fund; providing an
   15         effective date.

   17  Be It Enacted by the Legislature of the State of Florida:
   18  
   19         Section 1. Subsection (3) of section 206.46, Florida
   20  Statutes, is amended to read:
   21         206.46 State Transportation Trust Fund.—
   22         (3) Each fiscal year, at least a minimum of 15 percent but
   23  not more than 25 percent of all state revenues deposited into
   24  the State Transportation Trust Fund, excluding state revenues
   25  used for matching federal grants, shall be committed annually by
   26  the department for public transportation projects in accordance
   27  with chapter 311, ss. 332.003-332.007, chapter 341, and chapter
   28  343.
   29         Section 2. Subsection (2) of section 337.168, Florida
   30  Statutes, is amended to read:
   31         337.168 Confidentiality of official estimates, identities
   32  of potential bidders, and bid analysis and monitoring system.—
   33         (2) A document that reveals the identity of a person who
   34  has requested or obtained a bid package, plan, or specifications
   35  pertaining to any project to be let by the department is
   36  confidential and exempt from the provisions of s. 119.07(1) for
   37  the period that begins 2 working days before the deadline for
   38  obtaining bid packages, plans, or specifications and ends with
   39  the letting of the bid. A document that reveals the identity of
   40  a person who has requested or obtained a bid package, plan, or
   41  specifications pertaining to any project to be let by the
   42  department before the 2 working days before the deadline for
   43  obtaining bid packages, plans, or specifications remains a
   44  public record subject to s. 119.07(1).
   45         Section 3. Present paragraph (n) of subsection (1) of
   46  section 339.08, Florida Statutes, is redesignated as paragraph
   47  (o), and a new paragraph (n) is added to that subsection, to
   48  read:
   49         339.08 Use of moneys in State Transportation Trust Fund.—
   50         (1) The department shall expend moneys in the State
   51  Transportation Trust Fund accruing to the department, in
   52  accordance with its annual budget. The use of such moneys shall
   53  be restricted to the following purposes:
   54         (n)To pay for work zone speed enforcement by entering into
   55  an agreement with the Division of Florida Highway Patrol of the
   56  Department of Highway Safety and Motor Vehicles.
   57         Section 4. This act shall take effect July 1, 2022.
