       Senator Cruz moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 69 - 151
    4  and insert:
    5         (d) The department shall expedite all applications
    6  submitted by a spouse of an active duty member of the Armed
    7  Forces of the United States pursuant to this subsection and
    8  shall issue a license within 7 days after receipt of a complete
    9  application that includes all required documentation under
   10  subparagraphs (a)1.-4.
   11         Section 2. Present paragraphs (a), (c), and (e) through (i)
   12  of subsection (4) of section 456.024, Florida Statutes, are
   13  amended, and a new paragraph (i) is added to that subsection, to
   14  read:
   15         456.024 Members of Armed Forces in good standing with
   16  administrative boards or the department; spouses; licensure.—
   17         (4)(a) The board, or the department if there is no board,
   18  shall may issue a temporary professional license to the spouse
   19  of an active duty member of the Armed Forces of the United
   20  States who submits to the department:
   21         1. A completed application upon a form prepared and
   22  furnished by the department in accordance with the board’s
   23  rules;
   24         2. The required application fee;
   25         3. Proof that the applicant is married to a member of the
   26  Armed Forces of the United States who is on active duty;
   27         3.4. Proof that the applicant holds a valid license for the
   28  profession issued by another state, the District of Columbia, or
   29  a possession or territory of the United States, and is not the
   30  subject of any disciplinary proceeding in any jurisdiction in
   31  which the applicant holds a license to practice a profession
   32  regulated by this chapter;
   33         4.5. Proof that the applicant’s spouse is assigned to a
   34  duty station in this state pursuant to the member’s official
   35  active duty military orders; and
   36         5.6. Proof that the applicant would otherwise be entitled
   37  to full licensure under the appropriate practice act, and is
   38  eligible to take the respective licensure examination as
   39  required in Florida.
   40         (c) Each board, or the department if there is no board,
   41  shall review the results of the state and federal criminal
   42  history checks according to the level 2 screening standards in
   43  s. 435.04 when granting an exemption and when granting or
   44  denying the temporary license.
   45         (e) The department shall waive the applicant’s licensure
   46  set an application fee, which may not exceed the cost of issuing
   47  the license.
   48         (f) A temporary license expires 12 months after the date of
   49  issuance and is not renewable.
   50         (g) An applicant for a temporary license under this
   51  subsection is subject to the requirements under s. 456.013(3)(a)
   52  and (c).
   53         (g)(h) An applicant shall be deemed ineligible for a
   54  temporary license pursuant to this section if the applicant:
   55         1. Has been convicted of or pled nolo contendere to,
   56  regardless of adjudication, any felony or misdemeanor related to
   57  the practice of a health care profession;
   58         2. Has had a health care provider license revoked or
   59  suspended from another of the United States, the District of
   60  Columbia, or a United States territory;
   61         3. Has been reported to the National Practitioner Data
   62  Bank, unless the applicant has successfully appealed to have his
   63  or her name removed from the data bank; or
   64         4. Has previously failed the Florida examination required
   65  to receive a license to practice the profession for which the
   66  applicant is seeking a license.
   67         (h)(i) The board, or the department if there is no board,
   68  may revoke a temporary license upon finding that the individual
   69  violated the profession’s governing practice act.
   70         (i)The board, or the department if there is no board,
   71  shall expedite all applications submitted by a spouse of an
   72  active duty member of the Armed Forces of the United States
   73  pursuant to this subsection and shall issue a license within 7
   74  days after receipt of all required documentation for such
   75  application.

   82         professional license applications submitted by spouses
   83         of active duty members of the Armed Forces of the

   85         certain licenses within a specified timeframe;
   86         amending s. 456.024, F.S.; requiring the Department of
   87         Health and certain boards to issue a professional
   88         license to spouses of active duty members of the Armed
   89         Forces of the United States if certain requirements
   90         are met; requiring the department to waive the
   91         application fee for such license applications;
   92         requiring the department and certain boards to
   93         expedite applications for such licenses and to issue
   94         such licenses within a specified timeframe; conforming
