    1                        A bill to be entitled                      
    2         An act relating to fees; amending s. 320.031, F.S.;
    3         authorizing the Department of Highway Safety and Motor
    4         Vehicles to collect a mail service charge for mailed
    5         registration certificate cards; amending s. 320.04,
    6         F.S.; imposing a specified service charge for the
    7         transfer or duplicate issuance of a registration
    8         certificate card; providing a contingent effective
    9         date.

   11  Be It Enacted by the Legislature of the State of Florida:
   12  
   13         Section 1. Section 320.031, Florida Statutes, as amended by
   14  SB ____, 2022 Regular Session, is amended to read:
   15         320.031 Mailing of registration certificates, registration
   16  certificate cards, license plates, and validation stickers.—
   17         (1) The department and the tax collectors of the several
   18  counties of the state may at the request of the applicant use
   19  United States mail service to deliver registration certificates
   20  and registration certificate cards and renewals thereof, license
   21  plates, mobile home stickers, and validation stickers to
   22  applicants.
   23         (2) A mail service charge may be collected for each
   24  registration certificate, registration certificate card, license
   25  plate, mobile home sticker, and validation sticker mailed by the
   26  department or any tax collector. Each registration certificate,
   27  registration certificate card, license plate, mobile home
   28  sticker, and validation sticker shall be mailed by first-class
   29  mail unless otherwise requested by the applicant. The amount of
   30  the mail service charge shall be the actual postage required,
   31  rounded to the nearest 5 cents, plus a 25-cent handling charge.
   32  The mail service charge is in addition to the service charge
   33  provided by s. 320.04. All charges collected by the department
   34  under this section shall be deposited into the Highway Safety
   35  Operating Trust Fund.
   36         Section 2. Paragraph (a) of subsection (1) of section
   37  320.04, Florida Statutes, is amended to read:
   38         320.04 Registration service charge.—
   39         (1)(a) A service charge of $2.50 shall be imposed on each
   40  application that is handled in connection with original
   41  issuance, duplicate issuance, or transfer of a license plate,
   42  mobile home sticker, or validation sticker or with transfer or
   43  duplicate issuance of a registration certificate or a
   44  registration certificate card. This service charge shall be
   45  retained by the department or by the tax collector, as the case
   46  may be, as other fees accruing to those offices.
   47         Section 3. This act shall take effect on the same date that
   48  SB ____ or similar legislation takes effect, if such legislation
   49  is adopted in the same legislative session or an extension
   50  thereof and becomes a law.
