2 An act relating to telehealth prescribing; amending s.
3 456.47, F.S.; revising the circumstances under which a
4 telehealth provider may use telehealth to prescribe
5 certain controlled substances; providing an effective
6 date.

8 Be It Enacted by the Legislature of the State of Florida:

10 Section 1. Paragraph (c) of subsection (2) of section
11 456.47, Florida Statutes, is amended to read:
12 456.47 Use of telehealth to provide services.—
13 (2) PRACTICE STANDARDS.—
14 (c) A telehealth provider may not use telehealth to
15 prescribe a controlled substance listed in Schedule II of s.
16 893.03 unless the controlled substance is prescribed for the
17 following:
18 1. The treatment of a psychiatric disorder;
19 2. Inpatient treatment at a hospital licensed under chapter
20 395;
21 3. The treatment of a patient receiving hospice services as
22 defined in s. 400.601; or
23 4. The treatment of a resident of a nursing home facility
24 as defined in s. 400.021;
25 5. The treatment of a terminal condition as defined in s.
26 456.44(1)(a)2; or
27 6. The treatment of cancer.
28 Section 2. This act shall take effect July 1, 2023.
