It is the intent of the Legislature to ensure 6 that provisions of this act do not adversely affect the quality, 7 competitiveness, and research funding of public universities and 8 colleges within this state and that the high standards in the 9 public higher education system be maintained. To that end, this 10 section provides for the automatic repeal or reversion, as 11 applicable, of certain provisions created or amended by this act 12 if performance benchmarks as defined in this section are not 13 met. 14 (1) For purposes of this section, the term: 15 (a) “Performance benchmarks” refers to the minimum levels 16 of rankings or research funding which must be maintained by 17 public institutions of higher education to avoid the automatic 18 repeal of certain provisions of this act. 19 (b) “Public institution of higher education” means any 20 Florida College System institution or state university. 21 (c) “Rankings” refers to the positions held by public 22 institutions of higher education on established national or 23 international ranking lists. 24 (d) “Research funding” means the amount of external funding 25 received by public institutions of higher education to support 26 research activities. 27 (2)(a) The Department of Education, in conjunction with the 28 Board of Governors, shall establish performance benchmarks for 29 rankings and research funding of public institutions of higher 30 education within this state which benchmarks are subject to 31 periodic review and revision to reflect the changing landscape 32 of higher education and research funding over time. 33 (b) The Department of Education and the Board of Governors 34 shall monitor the rankings and research funding of public 35 institutions of higher education within this state and compare 36 them to established performance benchmarks. 37 (3)(a) If the rankings or research funding of public 38 institutions of higher education within this state, as monitored 39 and determined by the Department of Education and the Board of 40 Governors, falls below the established performance benchmarks, 41 this act is repealed and any statute amended by this act shall 42 revert to that in existence on June 30, 2023, except that any 43 amendments to such statutes enacted other than by this act shall 44 be preserved and continue to operate to the extent that such 45 amendments are not dependent upon the portions of text which 46 revert pursuant to this section. 47 (b) The Department of Education and the Board of Governors 48 shall notify the Legislature, the Governor, and the public 49 institutions of higher education within this state which are 50 affected by the repeal or reversion of law within 30 days after 51 the determination is made that the performance benchmarks have 52 not been met. 53 ================= T I T L E A M E N D M E N T ================ 54 And the title is amended as follows: 55 Between lines 104 and 105 56 insert: 57 legislative intent; defining terms; requiring the 58 Department of Education and the Board of Governors to 59 establish and monitor performance benchmark rankings 60 and research funding of public institutions of higher 61 education within this state; providing for the 62 automatic repeal of the act and the reversion of 63 specified provisions of the act if the rankings or 64 research funding fall below a certain benchmark; 65 requiring the department and the Board of Governors to 66 notify certain entities within a specified timeframe 67 after determining that such repeal and reversion will 68 occur; providing
