The Committee on Fiscal Policy (DiCeglie) recommended the
following:
1 Senate Amendment (with directory and title amendments)

3 Between lines 163 and 164
4 insert:
5 (ll)1. In addition to any other method of alternative
6 dispute resolution authorized by state law, the corporation may
7 adopt policy forms that provide for the resolution of disputes
8 regarding its claim determinations, including disputes regarding
9 coverage for, or the scope and value of, a claim, in a
10 proceeding before the Division of Administrative Hearings. Any
11 such policies are not subject to s. 627.70154.
12 2. The corporation may contract with the Division of
13 Administrative Hearings to conduct proceedings to resolve
14 disputes regarding its claim determinations as may be provided
15 for in the applicable policies of insurance.

18 And the directory clause is amended as follows:
19 Delete line 43
20 and insert:
21 section 627.351, Florida Statutes, are amended, and paragraph
22 (ll) is added to that subsection, to read:

27 insert:
28 authorizing the corporation to adopt policy forms that
29 provide for the resolution of certain disputes in
30 proceedings before the Division of Administrative
31 Hearings; providing that such policies are not subject
32 to mandatory binding arbitration provisions;
33 authorizing the corporation to contract with the
34 division to conduct proceedings;
