    1                        A bill to be entitled                      
    2         An act relating to designation of eligible
    3         telecommunications carriers; amending s. 364.10, F.S.;
    4         revising the definition of the term “eligible
    5         telecommunications carrier” to include certain
    6         commercial mobile radio service providers; authorizing
    7         the Public Service Commission to designate a
    8         commercial mobile radio service provider as an
    9         eligible telecommunications carrier for the purpose of
   10         providing Lifeline service; providing an effective
   11         date.

   13  Be It Enacted by the Legislature of the State of Florida:
   14  
   15         Section 1. Paragraph (a) of subsection (1) of section
   16  364.10, Florida Statutes, is amended to read:
   17         364.10 Lifeline service.—
   18         (1)(a) An eligible telecommunications carrier shall provide
   19  a Lifeline Assistance Plan to qualified residential subscribers,
   20  as defined in the eligible telecommunications carrier’s
   21  published schedules. For the purposes of this section, the term
   22  “eligible telecommunications carrier”:
   23         1. Means a telecommunications company, as defined by s.
   24  364.02, which is designated as an eligible telecommunications
   25  carrier by the commission pursuant to 47 C.F.R. s. 54.201; and
   26         2.Notwithstanding the provision of s. 364.011 which
   27  exempts certain commercial mobile radio service providers from
   28  commission oversight, includes any commercial mobile radio
   29  service provider designated by the commission pursuant to 47
   30  C.F.R. s. 54.201. The commission, upon petition, may make such a
   31  designation for the limited purpose of providing Lifeline
   32  service.
   33         Section 2. This act shall take effect upon becoming a law.
