    2         An act relating to wireless provider automatic
    3         location identification services; creating s.
    4         365.1755, F.S.; defining terms; requiring a wireless
    5         services provider to provide automatic location
    6         identification of an account holder’s wireless
    7         telephone in certain circumstances; requiring
    8         automatic location identification services to be
    9         provided through an emergency number created by the
   10         wireless services provider; requiring calls to such
   11         number to be answered immediately; requiring requested
   12         automatic identification information to be provided in
   13         a specified format; authorizing certain persons to
   14         contact a wireless services provider and request a
   15         block for a specified timeframe on an account holder’s
   16         ability to access automatic location identification
   17         services or information; requiring such requests to be
   18         confidential; authorizing a wireless services provider
   19         to charge a specified fee for automatic location
   20         identification services; providing an effective date.
   21          
   22  Be It Enacted by the Legislature of the State of Florida:
   23  
   24         Section 1. Section 365.1755, Florida Statutes, is created
   25  to read:
   26         365.1755Emergency telephone number; automatic location
   27  identification; wireless providers.—
   28         (1)As used in this section, the term:
   29         (a)“Account holder” means a person who is legally
   30  responsible and who enters into an agreement with a wireless
   31  telephone service provider for the purchase of a wireless
   32  telephone.
   33         (b)“Automatic location identification” means the automatic
   34  display at the Public Safety Answering Point of the caller’s
   35  mobile telephone number, the address or location of the wireless
   36  telephone, and supplementary emergency services information.
   37         (c)“Emergency” means a situation, physical condition, or
   38  method of operation which presents imminent danger of death or
   39  serious physical or mental harm to a person.
   40         (d)“Family or household member” means spouses; former
   41  spouses; persons related by blood or marriage; persons who are
   42  presently residing together as if a family or who have resided
   43  together in the past as if a family; and persons who are parents
   44  of a child in common regardless of whether they have been
   45  married. Except for persons who have a child in common, the
   46  family or household members must be currently residing or have
   47  in the past resided together in the same single dwelling unit.
   48         (e)“Mobile telephone number” means the telephone number
   49  assigned to a wireless telephone at the time of initial
   50  activation.
   51         (f)“Wireless services provider” means a person who
   52  provides services using licensed or unlicensed spectrum, whether
   53  at a fixed location or mobile, using wireless facilities.
   54         (2)In the event of an actual or perceived emergency, a
   55  wireless services provider shall, immediately upon the request
   56  of an account holder, provide automatic location identification
   57  of the account holder’s wireless telephone.
   58         (3)Automatic location identification services shall be
   59  provided through a unique and well-advertised emergency number
   60  created by the wireless services provider. There shall be no
   61  wait times for persons who call the emergency number.
   62         (4)Any automatic location identification information
   63  provided by the wireless services provider shall be verbally
   64  provided through and graphically transmitted to the wireless
   65  telephone, regardless of whether the automatic location
   66  identification service has been activated or deactivated on the
   67  wireless telephone, except as provided in section (5).
   68         (5)A family or household member of an account holder who
   69  uses the account holder’s wireless telephone may contact the
   70  wireless services provider and request a temporary block, not to
   71  exceed 30 days, on the account holder’s ability to obtain
   72  automatic location identification services or information. The
   73  request shall be confidential and may not be provided to the
   74  account holder.
   75         (6)A wireless services provider may charge a fee for
   76  automatic location identification services of no more than $5
   77  per request.
   78         Section 2. This act shall take effect July 1, 2023.
