    1                        A bill to be entitled                      
    2         An act relating to land and water management; amending
    3         s. 373.421, F.S.; requiring certain buffer zones for
    4         land or water delineations established by a county or
    5         municipality to be purchased by the county or
    6         municipality; prohibiting the acquisition of such
    7         zones by the use of eminent domain; creating s.
    8         403.8111, F.S.; preempting regulation of specified
    9         dredge and fill activities to the Department of
   10         Environmental Protection; providing construction;
   11         repealing s. 373.591, F.S., relating to land
   12         management review teams; providing an effective date.

   14  Be It Enacted by the Legislature of the State of Florida:
   15  
   16         Section 1. Subsection (8) is added to section 373.421,
   17  Florida Statutes, to read:
   18         373.421 Delineation methods; formal determinations.—
   19         (8)Buffer zones for land or water delineations established
   20  by a county or municipality that exceed the delineation
   21  determinations for such land or water by the Department of
   22  Environmental Protection or a water management district must be
   23  purchased by the county or municipality and may not be acquired
   24  by the use of eminent domain.
   25         Section 2. Section 403.8111, Florida Statutes, is created
   26  to read:
   27         403.8111Dredge and fill activities preemption.—The
   28  regulation of dredge and fill activities under this chapter and
   29  chapter 373 is preempted to the department. This section does
   30  not preclude the authority of the department to delegate powers
   31  to water management districts under chapter 373.
   32         Section 3. Section 373.591, Florida Statutes, is repealed.
   33         Section 4. This act shall take effect July 1, 2024.
