Innocent victim petroleum storage system restoration.
1376.30715 Innocent victim petroleum storage system restoration.--A contaminated site acquired prior to July 1, 1990, which has ceased operating as a petroleum storage or retail business prior to January 1, 1985, is eligible for financial assistance pursuant to s. 376.305(6), notwithstanding s. 376.305(6)(a). Eligible sites shall be ranked in accordance with s. 376.3071(5).

A. Section 28, ch. 2005-71, enacted s. 376.30715 "[i]n order to implement Specific Appropriation 1742 of the 2005-2006 General Appropriations Act." The proviso language relating to this appropriation was vetoed. See ch. 2005-70, the 2005-2006 General Appropriations Act.
B. Section 54, ch. 2005-71, provides that "[a] section of this act that implements a specific appropriation or specifically identified proviso language in the 2005-2006 General Appropriations Act is void if the specific appropriation or specifically identified proviso language is vetoed. A section of this act that implements more than one specific appropriation or more than one portion of specifically identified proviso language in the 2005-2006 General Appropriations Act is void if all the specific appropriations or portions of specifically identified proviso language are vetoed."
C. Section 55, ch. 2005-71, provides that "[i]f any other act passed in 2005 contains a provision that is substantively the same as a provision in this act, but that removes or is otherwise not subject to the future repeal applied to such provision by this act, the Legislature intends that the provision in the other act shall take precedence and shall continue to operate, notwithstanding the future repeal provided by this act." Section 4, ch. 2005-180, created s. 376.30715 and did not include a repeal provision.
