Florida House of Representatives - 1997 HB 1001 By Representative Bitner 1 A bill to be entitled 2 An act relating to insurance; amending s. 3 626.072, F.S.; authorizing general lines agents 4 and general lines agencies to appoint temporary 5 representatives to assist in transacting the 6 business of insurance or private passenger 7 motor vehicle insurance; providing conditions 8 of appointment; providing a limitation; 9 providing responsibilities of agents and 10 agencies that make such appointments; providing 11 responsibility; providing an effective date. 12 13 Be It Enacted by the Legislature of the State of Florida: 14 15 Section 1. Section 626.072, Florida Statutes, is 16 amended to read: 17 626.072 "Customer representative," "limited customer 18 representative," "temporary representative" "Customer 19 representative" and "limited customer representative" 20 defined.--For the purposes of this code: 21 (1) A "customer representative" is an individual 22 appointed by a general lines agent or general lines agency to 23 assist the agent or agency in transacting the business of 24 insurance from the office of the agent or agency. 25 (2) A "limited customer representative" is a customer 26 representative appointed by a general lines agent or general 27 lines agency to assist the agent or agency in transacting only 28 the business of private passenger motor vehicle insurance from 29 the office of the agent or agency. A limited customer 30 representative is subject to this code in the same manner as a 31 customer representative unless otherwise specified. 1 CODING: Words stricken are deletions; words underlined are additions. Florida House of Representatives - 1997 HB 1001 522-131-97 1 (3) A "temporary representative" is a person who does 2 not hold a license issued by the department and who is 3 appointed by a general lines agent or a general lines agency 4 to assist the agent or agency from its office in transacting 5 the business of insurance or in transacting the business of 6 private passenger motor vehicle insurance. A person may be 7 appointed a temporary representative only one time. The period 8 of an appointment may not exceed 180 days. Prior to being 9 appointed a temporary representative, a person must provide 10 the appointing agent or agency with evidence that he or she is 11 enrolled in a qualified insurance class and has applied to the 12 department for a license as a customer representative or 13 limited customer representative. Upon receipt of a certificate 14 of enrollment or other evidence of enrollment, the agent or 15 agency may appoint the person a temporary representative. The 16 agent or agency must then certify to the department that the 17 person appointed is an employee of the agent or agency, and 18 that the agent or agency will provide on-the-job training for 19 the temporary representative including quoting, writing, and 20 receipting insurance. An agent or agency that appoints a 21 person as its temporary representative is responsible for the 22 actions of such person relating to the insurance business of 23 the agent or agency. 24 Section 2.
