1 A bill to be entitled
2 An act relating to trust funds; creating the
3 Florida Universal Health Access Trust Fund, to
4 be administered by the Florida Universal Health
5 Access and Cost Containment Commission;
6 providing for source of moneys and purposes;
7 providing for future review and termination or
8 re-creation of the fund; providing a contingent
9 effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. The Florida Universal Health Access Trust
14 Fund is hereby created, to be administered by the Florida
15 Universal Health Access and Cost Containment Commission. Funds
16 shall be credited to the trust fund as provided in HB or
17 similar legislation, to be used for the purposes set forth
18 therein.
19 Section 2. (1) The Florida Universal Health Access
20 Trust Fund shall be terminated on July 1, 2002.
21 (2) Prior to the regular legislative session
22 immediately preceding the date on which the trust fund is
23 scheduled to be terminated, the Florida Universal Access and
24 Cost Containment Commission and the Governor shall recommend
25 to the President of the Senate and the Speaker of the House of
26 Representatives whether the trust fund should be allowed to
27 terminate or should be recreated. These recommendations shall
28 be based on a review of the purpose and use of the trust fund
29 and a determination of whether the trust fund will continue to
30 be necessary. A recommendation to recreate the trust fund may
31 include suggested modifications to the purpose, sources of

1 receipts, and allowable expenditures for the trust fund. The
2 commission's recommendation shall be made as a part of its
3 legislative budget request to the Legislature pursuant to s.
4 216.023, Florida Statutes. The Governor's recommendation shall
5 be made as a part of the recommended budget presented to the
6 Legislature pursuant to s. 216.162, Florida Statutes.
7 (3) If the trust fund is terminated, the commission
8 shall pay any outstanding debts or obligations of the trust
9 fund as soon as practicable and the Comptroller shall close
10 out and remove the trust fund from the various state
11 accounting systems, using generally accepted accounting
12 practices concerning warrants outstanding, assets, and
13 liabilities.
14 Section 3. This act shall take effect upon becoming a
15 law, if passed by a three-fifths vote of the membership of
16 each house, and if HB or similar legislation is adopted
17 in the same legislative session or an extension thereof.
