  1                      A bill to be entitled

  2         An act relating to court funding for new

  3         programs; amending s. 43.28, F.S.; providing

  4         that counties are not obligated to pay certain

  5         personnel costs related to court programs;

  6         providing an effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

  9

10         Section 1.  Section 43.28, Florida Statutes, is amended

11  to read:

12         43.28  Court facilities.--The counties shall provide

13  appropriate courtrooms, facilities, equipment, and, unless

14  provided by the state, personnel necessary to operate the

15  circuit and county courts, except that counties are not

16  obligated to pay for the personnel costs of new programs or

17  additional personnel costs for existing court programs under

18  the direction or supervision of the state court system after

19  July 1, 1998. Personnel costs shall include the costs of any

20  personnel needed to implement special divisions of the court

21  or to provide additional services to existing court programs,

22  including, but not limited to, an expansion of the use of

23  hearing officers.

24         Section 2.  This act shall take effect July 1, 1998.
