1 A bill to be entitled
2 An act relating to health care; amending s.
3 627.6472, F.S., and creating s. 641.3923, F.S.;
4 prohibiting exclusive provider organizations
5 and health maintenance organizations from
6 discriminating against participation by
7 licensed and certified advanced registered
8 nurse practitioners, solely on the basis of
9 such license or certification; providing an
10 effective date.

12 Be It Enacted by the Legislature of the State of Florida:

14 Section 1. Subsection (17) is added to section
15 627.6472, Florida Statutes, to read:
16 627.6472 Exclusive provider organizations.--
17 (17) An exclusive provider organization shall not
18 discriminate with respect to participation as to any advanced
19 registered nurse practitioner licensed and certified pursuant
20 to s. 464.012, who is acting within the scope of such license
21 and certification, solely on the basis of such license or
22 certification. This subsection shall not be construed to
23 prohibit a plan from including providers only to the extent
24 necessary to meet the needs of the plan's enrollees or from
25 establishing any measure designed to maintain quality and
26 control costs consistent with the responsibilities of the
27 plan.
28 Section 2. Section 641.3923, Florida Statutes, is
29 created to read:
30 641.3923 Discrimination against providers
31 prohibited.--A health maintenance organization shall not

1 discriminate with respect to participation as to any advanced
2 registered nurse practitioner licensed and certified pursuant
3 to s. 464.012, who is acting within the scope of such license
4 and certification, solely on the basis of such license or
5 certification. This section shall not be construed to prohibit
6 a plan from including providers only to the extent necessary
7 to meet the needs of the plan's enrollees or from establishing
8 any measure designed to maintain quality and control costs
9 consistent with the responsibilities of the plan.
10 Section 3. This act shall take effect upon becoming a
11 law.
