1 A bill to be entitled
2 An act relating to state government; creating
3 s. 11.074, F.S.; amending s. 120.54, F.S.;
4 requiring consideration of the impact of
5 legislation and rulemaking on families;
6 requiring impact statements; providing an
7 effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Section 11.074, Florida Statutes, is
12 created to read:
13 11.074 Assessment of impact of legislation on
14 families.--Before enacting any general or special law, each
15 house of the Legislature must consider the impact of the
16 proposed legislation on the formation, maintenance, and
17 general well-being of families consisting of those related by
18 blood, marriage, or adoption and living together. An impact
19 statement that assesses the potential effects of the proposed
20 legislation in light of the following questions must be
21 written and made available to the public:
22 (1) In what ways would this legislation strengthen the
23 stability of the family?
24 (2) Would this legislation strengthen the authority or
25 rights of parents in the education, nurturing, and supervision
26 of their children?
27 (3) Would the proposed benefits of this legislation
28 justify its impact on the family budget?
29 (4) What message, intended or otherwise, would this
30 legislation send to the public concerning the status of the
31 family?

2 A general law or special law shall not be declared invalid for
3 failure to comply with this section.
4 Section 2. Paragraph (e) is added to subsection (2) of
5 section 120.54, Florida Statutes, to read:
6 120.54 Rulemaking.--
7 (2) RULE DEVELOPMENT; WORKSHOPS; NEGOTIATED
8 RULEMAKING.--
9 (e) Each agency, before adopting, amending, or
10 repealing a rule or formulating and implementing a policy,
11 must consider the impact of the proposed rule or policy on the
12 formation, maintenance, and general well-being of families
13 consisting of those related by blood, marriage, or adoption,
14 and living together. An impact statement that assesses the
15 proposed rule or policy in light of the following questions
16 must be written and made available to the public:
17 1. In what ways would this rule or policy strengthen
18 the stability of the family?
19 2. Would this rule or policy strengthen the authority
20 or rights of parents in the education, nurturing, and
21 supervision of their children?
22 3. Would the proposed benefits of this rule or policy
23 justify its impact on the family budget?
24 4. What message, intended or otherwise, would this
25 rule or policy send to the public concerning the status of the
26 family?
27 Section 3. This act shall take effect October 1, 1998.
