19 (1) In recognition of the recent attempts to increase
20 the margin of reserve allowances provided for water and
21 wastewater utilities and the enhancement of the recovery of
22 environmental compliance costs by investor-owned and private
23 water and wastewater utilities, the Legislature finds that the
24 impact of such reserve requirements and costs to individual
25 ratepayers needs a thorough review and fact finding process.
26 Therefore, the investor-owned and private water and wastewater
27 study panel is established to review the need for rate
28 adjustment legislation and analysis of the infrastructure and
29 future growth needs of water and wastewater utilities. In
30 addition, the panel shall review the economic impact to
31 consumers of possible policy changes, such as mandated

1 environmental compliance costs and possible changes to the
2 period allowed for complying with required margins of reserve.
3 (2) The study panel shall be composed of 9 members,
4 which shall include: one member of the Senate and one member
5 of the House of Representatives, appointed by each respective
6 house; a representative from the Attorney General's office;
7 and two representatives from water and wastewater utilities,
8 one member of the Public Service Commission, one staff member
9 of a water and wastewater utility, a representative of the
10 American Association of Retired Persons, and one
11 representative from a county that has assumed responsibility
12 for regulating water and wastewater utilities under section
13 367.081, Florida Statutes, each of which shall be appointed by
14 the Governor.
15 (3) The study panel shall hold at least three public
16 hearings in various locations in the state, and shall seek
17 public comment and input. The members of the study panel are
18 entitled to reimbursement for travel and per diem expenses
19 incurred in the performance of their duties, as provided under
20 section 112.061, Florida Statutes. Such expenses shall be paid
21 from the budget of the Public Service Commission.
22 (4) The study panel shall report to the Governor and
23 the Legislature by January 15, 1999, on recommendations for
24 proposed legislation.
