1 A bill to be entitled
2 An act relating to rulemaking authority of the
3 Florida Public Service Commission (RAB);
4 authorizing the Florida Public Service
5 Commission to adopt rules relating to
6 purchasing, to ensuring adequate ownership or
7 continued use of real property upon which water
8 and wastewater treatment facilities are
9 located, and to notification when a water and
10 wastewater utility changes its name; providing
11 an effective date.

13 Be It Enacted by the Legislature of the State of Florida:

15 Section 1. The Florida Public Service Commission may
16 adopt rules and procedures for purchases of commodities and
17 services, including procurement of vehicles, office space, and
18 contractual services necessary for efficient operation. These
19 procedures must recognize that fair and open competition is a
20 basic tenet of public procurement and that both documentation
21 of the acts taken and effective monitoring mechanisms are
22 important to the process.
23 Section 2. A utility under the Water and Wastewater
24 System Regulatory Law must own the land or possess the right
25 to continued use of the land upon which treatment facilities
26 are located. The commission shall adopt rules in accordance
27 with this section.
28 Section 3. A water and wastewater utility shall notify
29 the commission and its customers before changing its name. The
30 commission may adopt rules that a water and wastewater utility
31 must follow when giving this notice to its customers.

1 Section 4. This act shall take effect upon becoming a
2 law.
