1 A bill to be entitled
2 An act relating to the Secretary of State;
3 providing for the appointment of a State Song
4 Commission to hold a contest for the selection
5 of the official state song in Florida;
6 directing the commission to provide for the
7 rules of the contest; providing for a
8 scholarship for the winner; directing the
9 commission to prepare certain legislation;
10 providing an effective date.

12 Be It Enacted by the Legislature of the State of Florida:

14 Section 1. State Song Commission created; appointment;
15 powers and duties; recommendation to Legislature.--
16 (1) There is hereby created a State Song Commission
17 which shall be composed of 11 members who shall be selected in
18 such a manner as to reflect the ethnic, cultural, and
19 geographical makeup of the state.
20 (a)1. One member shall be nominated by the Florida
21 Arts Council as created in s. 265.285, Florida Statutes, and
22 shall be appointed by the Secretary of State.
23 2. One member shall be nominated by the Historic
24 Preservation Advisory Council as created in s. 267.0612,
25 Florida Statutes, and shall be appointed by the Secretary of
26 State.
27 3. One member shall be a scholar in music appointed by
28 the Secretary of State.
29 4. One member shall be a scholar in literature
30 appointed by the Secretary of State.

1 5. Two members shall be members of the general public
2 appointed by the Secretary of State.
3 (b) Five members shall be appointed by the Governor.
4 (2) Members of the commission shall serve without
5 compensation or honorarium but shall be entitled to receive
6 reimbursement for per diem and travel expenses incurred in the
7 performance of their duties as provided in s. 112.061, Florida
8 Statutes.
9 (3) All actions taken by the commission shall be by a
10 vote of two-thirds of those present.
11 (4) The commission shall:
12 (a) Hold a contest for the selection of the official
13 state song of Florida. The commission shall establish the
14 rules for such a contest. In addition to any other rules the
15 commission may provide, the rules shall provide:
16 1. The contest shall be open to any resident of the
17 state.
18 2. The winner of the contest shall be awarded a full
19 4-year tuition waiver scholarship to any state university in
20 Florida which may be used by the winner or any person
21 nominated by the winner, or, if the winner does not choose to
22 attend a state university in Florida, a scholarship in an
23 amount equivalent to a full 4-year tuition scholarship at a
24 state university in Florida to any school in the United
25 States.
26 (b) The commission shall, upon the selection of the
27 official state song, prepare legislation amending chapter 15
28 of the Florida Statutes declaring Florida's official state
29 song for introduction by a member of either house of the
30 Legislature at the next regular session of the Florida
31 Legislature.

1 (5) This section is hereby repealed effective July 1,
2 1998.
3 Section 2. This act shall take effect July 1, 1997.

6 HOUSE SUMMARY

Provides for the creation of an 11-member State Song
8 Commission. Directs the commission to hold a statewide
contest among Florida residents for the selection of an
9 official state song. Provides that the winner shall
receive a 4-year tuition waiver scholarship. Directs the
10 commission to prepare legislation for introduction by a
member of either house of the Legislature for submission
11 at the next Regular Session of the Legislature amending
chapter 15, Florida Statutes, declaring the official
12 state song of Florida.
