1 A bill to be entitled
2 An act relating to the Secretary of State;
3 providing for the appointment of a State Song
4 Commission to hold a contest for the selection
5 of the official state song in Florida;
6 directing the commission to provide for the
7 rules of the contest; providing for a
8 scholarship for the winner; directing the
9 commission to prepare certain legislation;
10 providing for an appropriation; providing an
11 effective date.

13 Be It Enacted by the Legislature of the State of Florida:
14
15 Section 1. State Song Commission created; appointment;
16 powers and duties; recommendation to Legislature.--
17 (1) There is hereby created a State Song Commission
18 which shall be composed of 11 members who shall be selected in
19 such a manner as to reflect the ethnic, cultural, and
20 geographical makeup of the state.
21 (a)1. One member shall be nominated by the Florida
22 Arts Council as created in s. 265.285, Florida Statutes, and
23 shall be appointed by the Secretary of State.
24 2. One member shall be nominated by the Historic
25 Preservation Advisory Council as created in s. 267.0612,
26 Florida Statutes, and shall be appointed by the Secretary of
27 State.
28 3. One member shall be a scholar in music appointed by
29 the Secretary of State.
30 4. One member shall be a scholar in literature
31 appointed by the Secretary of State.

1 5. Two members shall be members of the general public
2 appointed by the Secretary of State.
3 (b) Five members shall be appointed by the Governor.
4 (2) Members of the commission shall serve without
5 compensation or honorarium but shall be entitled to receive
6 reimbursement for per diem and travel expenses incurred in the
7 performance of their duties as provided in s. 112.061, Florida
8 Statutes.
9 (3) All actions taken by the commission shall be by a
10 vote of two-thirds of those present.
11 (4) The commission shall:
12 (a) Hold a contest for the selection of the official
13 state song of Florida. The commission shall establish the
14 rules for such a contest, which must comply with all
15 applicable state and federal laws relating to such a contest,
16 and shall include the following provisions:
17 1. The contest shall be open to any resident of the
18 State of Florida, except employees of the state government, or
19 members of the Florida Legislature, or their immediate
20 families, or members of the commission, or of the commission
21 members' immediate families. For purposes of this contest,
22 immediate family members include: parents, children,
23 step-children, and siblings.
24 2. The winner of the contest shall be awarded a full
25 four-year, matriculation and required-fee waived, scholarship
26 to any state university in Florida, which may be used by the
27 winner, or any member of the winner's family nominated by the
28 winner, who is also a resident of the State of Florida. For
29 purposes of this contest, family means: parents,
30 step-parents, children, step-children, siblings,
31 grandchildren, nephews and nieces. If the winner, or the

1 winner's nominee, does not choose to attend a state
2 university, a scholarship in an amount equivalent to a full
3 four-year matriculation and required-fee waived scholarship at
4 a state university in Florida will be awarded for use at any
5 regionally accredited community college, junior college,
6 technical school, or vocational school in the State of
7 Florida. No public funds will be spent implementing this
8 bill.
9 (b) The commission shall, upon the selection of the
10 official state song, prepare legislation amending chapter 15
11 of the Florida Statutes declaring Florida's official state
12 song for introduction by a member of either house of the
13 Legislature at the next regular session of the Florida
14 Legislature. In order to preserve elements of Florida's
15 heritage, each prior official state song will be given the
16 title: "Historical State Song". The new song must be
17 designated as "Modern Day State Song". Both these
18 designations must be included in any official state
19 publication.
20 (5) This section is hereby repealed effective July 1,
21 1998.
22 Section 2. There is hereby appropriated $22,000 in the
23 Grants and Donations Trust Fund within the Division of
24 Administrative Services in the Office of the Secretary of
25 State to implement the provisions of this legislation. All
26 funds appropriated for this purpose are to be from non-state
27 sources.
28 Section 3. This act shall take effect July 1, 1997.
