1 A bill to be entitled
2 An act relating to elections; changing the date
3 of the second primary election in 1998;
4 ensuring that dates tied to the date of the
5 second primary remain unchanged, with specified
6 exceptions; amending s. 106.15, F.S.;
7 prohibiting political contributions in
8 government buildings; providing an effective
9 date.

11 WHEREAS, the second primary election in 1998 falls on
12 September 29, 1998, and
13 WHEREAS, Yom Kippur, or the Jewish Day of Atonement,
14 which is a day marked by fasting and continuous prayers of
15 repentance, occurs on that day, and
16 WHEREAS, the conducting of the second primary election
17 on September 29, 1998, would cause great hardship to voters of
18 the Jewish faith, causing many to be unable to vote and
19 prohibiting many from participating as election workers or
20 participating in other election activities, NOW, THEREFORE,
21
22 Be It Enacted by the Legislature of the State of Florida:

24 Section 1. Notwithstanding section 100.091, Florida
25 Statutes, or any other law to the contrary, the date of the
26 second primary election in 1998 is changed from Tuesday,
27 September 29, 1998, to Thursday, October 1, 1998. However,
28 for purposes of the 1998 general election cycle, all dates in
29 the Florida Election Code tied to the date of the second
30 primary election remain set as if the second primary election
31 were to be held on September 29, 1998, except that elections

1 to be held in conjunction with the second primary election
2 shall be held on October 1, 1998, and restrictions on changes
3 in party affiliation between the first and second primary
4 elections shall remain in effect for the extended period
5 resulting from the change in the date of the second primary
6 election effected by this act.
7 Section 2. Subsection (4) of section 106.15, Florida
8 Statutes, is amended to read:
9 106.15 Certain acts prohibited.--
10 (4) No person shall make and no person shall solicit
11 or knowingly accept any political campaign contribution in a
12 building owned by a governmental entity. For purposes of this
13 subsection, "accept" means to receive a contribution by
14 personal hand delivery from a contributor or the contributor's
15 agent. This subsection shall not apply when a
16 government-owned building or any portion thereof is rented for
17 the specific purpose of holding a campaign fundraiser.
18 Section 3. This act shall take effect upon becoming a
19 law.
