9 definition; providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Section 641.3155, Florida Statutes, is
14 created to read:
15 641.3155 Termination or nonrenewal of health care
16 provider contracts.--All health care provider contracts
17 entered into after the effective date of this act shall
18 include a provisional period of 1 year. During the
19 provisional period, or at the conclusion of the 1-year
20 provisional period, the contract may be terminated by either
21 party without cause or explanation. Such contracts shall be
22 for a minimum period of 2 years unless an extended time period
23 is agreed to by both parties. After the provisional 1-year
24 period has expired without action on the part of either party,
25 such contracts may be terminated only for cause or by mutual
26 consent of both parties. Each contract shall include the
27 conditions or terms that would constitute cause for
28 termination of the contract. All health care provider
29 contracts between the same parties shall include only one
30 provisional period. All future health care provider contracts
31 between those parties shall not include the provisional period

1 and may be terminated only for cause or by mutual consent of
2 both parties. For purposes of this section, "health care
3 provider" is defined as any practitioner licensed under
4 chapter 458, chapter 459, chapter 460, or chapter 461, and any
5 facility licensed under chapter 395.
6 Section 2. This act shall take effect October 1 of the
7 year in which enacted.
