  1                      A bill to be entitled

  2         An act relating to sentencing; repealing s.

  3         921.001, F.S., relating to the Sentencing

  4         Commission and sentencing guidelines,

  5         generally; abolishing the Sentencing

  6         Commission; eliminating certain general

  7         provisions with respect to the sentencing

  8         guidelines; repealing s. 921.005, F.S.,

  9         relating to sentencing criteria; providing

10         discretion in sentencing to the trial judge;

11         providing an effective date.

13  Be It Enacted by the Legislature of the State of Florida:

15         Section 1.  Section 921.001, Florida Statutes, as

16  amended by chapter 95-184, Laws of Florida, and section

17  921.005, Florida Statutes, are repealed.

18         Section 2.  The sentencing judge in criminal trials is

19  hereby authorized to sentence, within its discretion, within

20  the confines of existing minimums and maximums as required by

21  law.

22         Section 3.  This act shall take effect January 1, 1998.
