1 A bill to be entitled
2 An act relating to the Florida Crimes
3 Compensation Act; amending s. 960.03, F.S.;
4 revising the definition of "crime" with respect
5 to the Florida Crimes Compensation Act;
6 conforming terminology and a cross reference;
7 expanding the definition to include certain
8 acts of mass violence and international
9 terrorism committed against residents of this
10 state; providing an effective date.

12 Be It Enacted by the Legislature of the State of Florida:
13
14 Section 1. Subsection (3) of section 960.03, Florida
15 Statutes, 1996 Supplement, is amended to read:
16 960.03 Definitions.--As used in ss. 960.01-960.28,
17 unless the context otherwise requires, the term:
18 (3) "Crime" means:
19 (a) the commission by any person, including a juvenile
20 offender, of A felony or misdemeanor offense committed by
21 either an adult or a minor punishable under the laws of this
22 state, which results in physical injury or death. The term
23 also includes any such criminal act which is committed within
24 this state but which falls exclusively within federal
25 jurisdiction.
26 (b) "Crime" also includes any A violation of s.
27 316.193, s. 316.027(1)(2), or s. 782.071(2), which results in
28 physical injury or death; however, no other act involving the
29 operation of a motor vehicle, boat, or aircraft which results
30 in injury or death shall constitute a crime for the purpose of
31 this chapter unless the injury or death was intentionally

1 inflicted through the use of such vehicle, boat, or aircraft
2 or unless such vehicle, boat, or aircraft is an implement of a
3 crime to which this act applies.
4 (c) "Crime" also includes any such A criminal act
5 committed outside of this state against a resident of this
6 state that would have been compensable if it had occurred in
7 this state and that occurred in a state that does not have an
8 eligible crime victim compensation program as the term is
9 defined in the federal Victims of Crime Act of 1984.
10 (d) An act of mass violence or an act of international
11 terrorism, as defined in 18 U.S.C. s. 2331, that is committed
12 outside of the territorial boundaries of the United States
13 upon a resident of this state, when such act results in
14 physical injury or death and the person is not eligible for
15 compensation under Title VIII of the Omnibus Diplomatic
16 Security and Antiterrorism Act of 1986.
17 Section 2. This act shall take effect upon becoming a
18 law.

Revises the definition of "crime" for purposes of the
23 Florida Crimes Compensation Act. Specifies that certain
crimes which result in physical injury or death and are
24 "committed by either an adult or a minor" fall under the
definition. Conforms a cross reference. Expands the
25 definition of "crime" for purposes of the act to include
certain acts of mass violence and international terrorism
26 committed against residents of this state.
