2 An act relating to general labor regulations;
3 creating s. 448.055, F.S.; creating the
4 "Florida Minimum Wage Act"; providing
5 definitions; requiring employers to provide
6 certain breaks for each employee during each
7 8-hour work period; providing for a minimum
8 wage; providing an effective date.

10 Be It Enacted by the Legislature of the State of Florida:

12 Section 1. Section 448.055, Florida Statutes, is
13 created to read:
14 448.055 Florida Minimum Wage Act.--
15 (1) DEFINITIONS.--As used in this section:
16 (a) "Employee" means any individual employed by an
17 employer, including individuals employed by the state, its
18 political subdivisions, or agencies and instrumentalities
19 thereof.
20 (b) "Employer" means any person who employs two or
21 more employees.
22 (c) "Wages" means and includes all compensation paid
23 by an employer or his agent for the performance of service by
24 an employee, including the cash value of all compensation paid
25 in any medium other than cash.
26 (2) APPLICATION OF SECTION.--This section shall apply
27 to every employer who is not governed by any federal minimum
28 age law.
29 (3) REQUIRED MINIMUM BREAKS.--Every employer governed
30 by the provisions of this section shall provide a minimum of

1 two 15-minute breaks and one 30-minute break in each 8-hour
2 work period for each employee.
3 (4) MINIMUM WAGE REQUIRED.--Each employer governed by
4 the provisions of this section shall pay a minimum of $3.50
5 per hour for each hour of employment for each employee.
6 Section 2. This act shall take effect October 1, 1997.
