  1                      A bill to be entitled

  2         An act relating to interception of

  3         communications; amending s. 934.09, F.S.;

  4         requiring notice and opportunity to consent or

  5         refuse to consent to interception of

  6         communications; providing an effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

10         Section 1.  Subsection (12) is added to section 934.09,

11  Florida Statutes, to read:

12         934.09  Procedure for interception of wire, oral, or

13  electronic communications.--

14         (12)  Notwithstanding any other provision of this

15  section, all parties to any interception of wire, electronic,

16  or oral communication shall be informed that the communication

17  is being intercepted and all parties shall be given the

18  opportunity to consent or refuse to consent to the

19  interception.

20         Section 2.  This act shall take effect October 1, 1997.
