2 An act relating to courses of study and
3 instructional materials; amending s. 233.061,
4 F.S.; including the study of Hispanic
5 contributions to the the United States in
6 required public school instruction; amending s.
7 233.34, F.S.; revising provisions relating to
8 the purchase of instructional materials not on
9 the state-adopted list; providing an effective
10 date.

12 Be It Enacted by the Legislature of the State of Florida:

14 Section 1. Paragraph (o) is added to subsection (2) of
15 section 233.061, Florida Statutes, to read:
16 233.061 Required instruction.--
17 (2) Members of the instructional staff of the public
18 schools, subject to the rules and regulations of the
19 commissioner, the state board, and the school board, shall
20 teach efficiently and faithfully, using the books and
21 materials required, following the prescribed courses of study,
22 and employing approved methods of instruction, the following:
23 (o) The study of Hispanic contributions to the United
24 States.
25 Section 2. Subsection (2) of section 233.34, Florida
26 Statutes, is amended to read:
27 233.34 Use of instructional materials allocation;
28 instructional materials, library books, and reference books;
29 repair of books.--
30 (2) Each school district shall use the annual
31 allocation for the purchase of instructional materials

1 included on the state-adopted list or for the purchase of
2 instructional materials not on the state-adopted list the
3 purchase of which is negotiated directly with textbook
4 companies. No less than 50 percent of the annual allocation
5 shall be used to purchase items which will be used to provide
6 instruction to students at the level or levels for which the
7 materials are designed. However, up to 50 percent of The
8 annual allocation may be used for the purchase of
9 instructional materials, including library and reference books
10 and nonprint materials, not included on the state-adopted list
11 and for the repair and renovation of textbooks and library
12 books. Notwithstanding the provisions of this subsection,
13 school districts may use 100 percent of that portion of the
14 annual allocation which is designated by the district for the
15 purchase of instructional materials for kindergarten, and 75
16 percent of that portion of the annual allocation which is
17 designated for the purchase of instructional materials for
18 first grade, to purchase materials not on the state-adopted
19 list.
20 Section 3. This act shall take effect July 1 of the
21 year in which enacted.
