Florida House of Representatives - 1997 HB 1161 By Representative Meek 1 A bill to be entitled 2 An act relating to funding for criminal 3 proceedings; amending ss. 27.38, 27.60, F.S.; 4 revising the budget transfer authority of state 5 attorneys and public defenders; providing an 6 effective date. 7 8 Be It Enacted by the Legislature of the State of Florida: 9 10 Section 1. Subsection (1) of section 27.38, Florida 11 Statutes, is amended to read: 12 27.38 Budget transfer authority.-- 13 (1) Notwithstanding the provisions of s. 216.292, each 14 state attorney, whenever he or she deems it necessary by 15 reason of changed conditions, may transfer appropriations 16 funded from identical funds as prescribed in s. 215.32, except 17 appropriations for fixed capital outlay, and transfer the 18 amounts included within the total original approved budget and 19 releases as furnished pursuant to ss. 216.181 and 216.192, as 20 follows: 21 (a) Between categories of appropriations within a 22 budget entity, if no category of appropriation is changed 23 increased or decreased by more than $100,000 $25,000 plus 5 24 percent of the original approved budget by all action taken 25 under this subsection. 26 (b) Additionally, between budget entities within 27 identical categories of appropriations, if no category of 28 appropriation is changed increased or decreased by more than 29 $100,000 $25,000 plus 5 percent of the original approved 30 budget by all action taken under this subsection. 31 1 CODING: Words stricken are deletions; words underlined are additions. Florida House of Representatives - 1997 HB 1161 572-134-97 1 Such authorized revisions, together with related changes, if 2 any, in the plan for release of appropriations, shall be 3 transmitted by the state attorney to the Comptroller for entry 4 in his or her records in the manner and format prescribed by 5 the Executive Office of the Governor in consultation with the 6 Comptroller. A copy of such revision shall be furnished the 7 Executive Office of the Governor, the chairs of the 8 legislative appropriations committees, and the Auditor 9 General. 10 Section 2.
