  1                      A bill to be entitled

  2         An act relating to trust funds; creating the

  3         Charter Schools Capital Outlay Trust Fund;

  4         providing for administration by the Department

  5         of Education; providing for sources of moneys

  6         and purposes; providing for annual carryover of

  7         moneys; providing for future review and

  8         termination or re-creation of the trust fund;

  9         providing a contingent effective date.

11  Be It Enacted by the Legislature of the State of Florida:

13         Section 1.  Charter Schools Capital Outlay Trust

14  Fund.--

15         (1)  The Charter Schools Capital Outlay Trust Fund is

16  created and shall be administered by the Department of

17  Education. The trust fund shall consist of moneys appropriated

18  by the Legislature for expenditure for capital outlay purposes

19  as provided in Senate Bill 1182 or similar legislation.

20         (2)  Notwithstanding the provisions of section 216.301,

21  Florida Statutes, and pursuant to section 216.351, Florida

22  Statutes, any balance in the trust fund at the end of any

23  fiscal year shall remain in the trust fund and shall be

24  available for carrying out the purposes of the trust fund in

25  subsequent years.

26         (3)  Pursuant to section 19(f)(2), Article III of the

27  State Constitution, the Charter Schools Capital Outlay Trust

28  Fund shall, unless terminated sooner, be terminated on July 1,

29  2002. However, before its scheduled termination, the trust

30  fund shall be reviewed as provided in section 215.3206(1) and

31  (2), Florida Statutes.

  1         Section 2.  This act shall take effect July 1, 1998,

  2  but it shall not take effect unless it is enacted by a

  3  three-fifths vote of the membership of each house of the

  4  Legislature and unless Senate Bill 1182 or similar legislation

  5  providing guidelines for distribution of moneys from the fund

  6  is enacted in the same legislative session or an extension

  7  thereof.

12  Identifies the bill (SB 1182) that would provide guidelines
    for distributing funds from the proposed Charter Schools
13  Capital Outlay Trust Fund.
