1 A bill to be entitled
2 An act relating to State University System
3 faculty members; providing for confidentiality
4 of records relating to promotion, reemployment,
5 and tenure; providing an exemption from the
6 public meetings law for proceedings relating to
7 the promotion, reemployment, or tenure of
8 faculty members; providing for legislative
9 review and future repeal; providing a statement
10 of public necessity; providing an effective
11 date.

13 Be It Enacted by the Legislature of the State of Florida:
14
15 Section 1. (1) Any evaluation, report,
16 correspondence, file, or other written or recorded
17 communication relating to the promotion, reemployment, or
18 tenure of a faculty member in the State University System is
19 confidential and exempt from section 119.07(1), Florida
20 Statutes, and section 24(a), Article I of the State
21 Constitution.
22 (2) Proceedings and hearings conducted for the purpose
23 of the promotion, reemployment, or tenure of a faculty member
24 in the State University System are exempt from the provisions
25 of section 286.011, Florida Statutes, and section 24(b),
26 Article I of the State Constitution.
27 (3) This section is subject to the Open Government
28 Sunset Review Act of 1995 in accordance with section 119.15,
29 Florida Statutes, and is repealed on October 2, 2003, unless
30 reviewed and saved from repeal through reenactment by the
31 Legislature before that date.

1 Section 2. The Legislature finds that it is a public
2 necessity that information concerning faculty members who are
3 being considered for promotion, retention, or tenure be kept
4 confidential and exempt from the public records law. The
5 release of such information could be potentially detrimental
6 to the ability of such faculty members to earn a living and
7 could result in unwarranted damage to the good name or
8 reputation of such faculty members. In addition the
9 Legislature finds that it is a public necessity that records
10 be protected and meetings be closed to the public so that such
11 proceedings are not otherwise significantly impaired. Such an
12 exemption will create a secure environment in which faculty
13 meetings relating to promotion, reemployment, and tenure are
14 conducted.
15 Section 3. This act shall take effect July 1, 1998.

19 Provides for confidentiality of records relating to
promotion, reemployment, and tenure of faculty members of
20 the State University System. Provides an exemption from
the public meeting law for proceedings relating to such
21 matters. Provides for future review and repeal. Provides
