18 (c) A violation of this subsection by a physician
19 shall constitute grounds for disciplinary action under s.
20 458.331 or s. 459.015. However, criminal penalties provided
21 under subsection (9) shall not apply unless the physician's
22 failure to obtain informed consent is willful and intentional.
23 Substantial compliance or reasonable belief that furnishing
24 the information would have a severely adverse effect on the
25 physical or mental health of the patient is a defense to any
26 civil or administrative action or criminal prosecution brought
27 under this subsection.
