3 465.004, F.S.; increasing the membership of the
4 Board of Pharmacy; revising membership
5 qualifications; providing an effective date.

7 Be It Enacted by the Legislature of the State of Florida:

9 Section 1. Subsections (1) and (2) of section 465.004,
10 Florida Statutes, are amended to read:
11 465.004 Board of Pharmacy.--
12 (1) The Board of Pharmacy is created within the
13 department and shall consist of nine seven members to be
14 appointed by the Governor and confirmed by the Senate.
15 (2) Seven Five members of the board must be licensed
16 pharmacists who are residents of this state and who have been
17 engaged in the practice of the profession of pharmacy in this
18 state for at least 4 years and, to the extent practicable,
19 represent the various pharmacy practice settings. Of the
20 pharmacist members, one must be on the full-time faculty of a
21 pharmacy school in this state, one must be currently engaged
22 in the practice of pharmacy in a community pharmacy, one must
23 be currently engaged in the practice of pharmacy in a Class II
24 institutional pharmacy or a Modified Class II institutional
25 pharmacy, and four shall be pharmacists licensed in this state
26 irrespective of practice setting. The remaining two members
27 must be residents of the state who have never been licensed as
28 pharmacists and who are in no way connected with the practice
29 of the profession of pharmacy. No person may be appointed as
30 a consumer lay member who is in any way connected with a drug

1 manufacturer or wholesaler. At least one member of the board
2 must be 60 years of age or older.
3 Section 2. This act shall take effect October 1, 1997.

6 HOUSE SUMMARY

Increases the membership of the Board of Pharmacy to nine
8 members, consisting of seven pharmacist members and two
consumer members. Revises membership qualifications for
9 the pharmacist members to provide that, to the extent
practicable, they represent the various pharmacy practice
