  1                      A bill to be entitled

  2         An act relating to rulemaking authority of the

  3         Agency for Health Care Administration (RAB);

  4         amending s. 408.08, F.S.; authorizing the

  5         agency to adopt rules under which health care

  6         facilities may be granted extensions of

  7         deadlines for filing certain reports; providing

  8         an effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11

12         Section 1.  Subsection (13) of section 408.08, Florida

13  Statutes, is amended to read:

14         408.08  Inspections and audits; violations; penalties;

15  fines; enforcement.--

16         (13)  Any health care facility that refuses to file a

17  report, fails to timely file a report, files a false report,

18  or files an incomplete report and upon notification fails to

19  timely file a complete report required under this section and

20  s. 408.061; that violates any provision of this section, s.

21  408.061, or s. 408.20, or rule adopted thereunder; or that

22  fails to provide documents or records requested by the agency

23  under the provisions of this chapter shall be punished by a

24  fine not exceeding $1,000 per day for each day in violation,

25  to be imposed and collected by the agency. Pursuant to rules

26  adopted by the agency, the agency may, upon a showing of good

27  cause, grant a one-time extension of any deadline for a health

28  care facility to timely file a report as required by this

29  section, s. 408.061, s. 408.072, or s. 408.20.

30         Section 2.  This act shall take effect upon becoming a

31  law.
